Terms and Conditions for Packu App

These Terms and Conditions govern your use of the Packu mobile application ("the app") and constitute a legally binding agreement between you and Packu. By using the app, you agree to be bound by these terms.

1. Delivery Services

The Packu app connects customers with self-employed drivers for delivery services. Drivers are fully responsible for the items they accept for delivery once they have picked them up. Packu does not assume responsibility for any damages, losses, or delays caused during the delivery process. Once the driver picks up the item, Packu will not be liable for any issues regarding the item delivery. For any problems, customers must directly contact the driver and resolve the issue with them. Drivers will make every effort to deliver items on time; however, customers need to ensure that someone is available at the destination address to receive the item. If no one is available, the driver will leave the item in a location they deem safe. Any issues after this must be resolved between the driver and the customer, as Packu is merely a channel connecting drivers and customers and is not liable for any issues between them.

2. Refunds and Cancellations

Refunds for delivery services are only possible before the driver accepts the job. Once the driver has accepted the job, refunds will no longer be possible. Packu is not responsible for refunds after this point. This does not affect your statutory rights under the Consumer Rights Act 2015.

3. User Responsibilities

Users of the Packu app agree to provide accurate and complete information for delivery requests. Users are responsible for ensuring that the items for delivery are appropriately packaged and ready for transport.

4. Limitation of Liability

Packu and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

Packu's aggregate liability for all claims relating to the app is limited to refunds for delivery services before the driver accepts the job. Once the driver accepts the job, Packu is not liable for any amount. This limitation of liability does not apply to liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law.

5. Privacy

Your use of the app is also subject to our Privacy Policy, which explains how we collect, use, and disclose your information. By using the app, you consent to the collection and use of your information as described in the Privacy Policy. We comply with the UK GDPR and Data Protection Act 2018.

6. Changes to Terms and Conditions

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting on the app. Your continued use of the app after the posting of changes constitutes your binding acceptance of such changes.

7. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law principles.
